The Employment Relations Authority resolves employment relationship problems that cannot be solved through mediation. The Authority is an investigative body that operates in an informal way. It looks into the facts and makes a decision based on the merits of the matter, not on technicalities.

Processes available to help sort out problems

The main steps in bringing a problem to the Employment Relations Authority are:

  1. Lodging an application - forms to do this are on the Authority’s website
  2. Getting the issues straight - preparation ahead of the investigation meeting.
  3. Investigation meeting - where the Authority member hears from both parties and asks questions to discover the facts.
  4. Deliberation by an Authority member and determination - the member makes their decision on the problem.
  5. After the Authority determination - taking the matter further.

These steps are outlined in the Authority’s website.

The Authority must consider whether mediation will be helpful in resolving the problem.  At any stage in the proceedings it can direct the parties to try mediation, whether or not they have done so already.

Employers and employees can choose to be represented in the Employment Relations Authority.
